Name one Gov't regulatory agency that you really think "squirms" at the thought of a tin gun lawsuit for their reported inept handling of a situation? ...and how many have actually had their actions reprimanded and procedures reversed?
The SEC? (think Bernie Madoff and how culpable the SEC was in that situation).
The FCC?
The IRS?
The XYZ?

I think you have to get real here.
There are class action suits mounting against the officers of this bank as we speak.
Is that fair? Probably not...I think these guys made every effort humanly possible to save their bank and came up a day late and dollar short...they were within inches of reaching their goal...it's kinda sad actually...but I can promise you this little bank does not have the Regulators "backed into a corner".
Good case or not - our Gov't Regulatory Agencies are known for their ineptnes..it's a given...so ultimately why won't they be excused this time as well! They may get a wrist slap but no property will be returned to UWBK imo.
I hope the Bank wins...but I don't see it remotely happening.
