I will take money from on-going revenue any day over the prospect of a distant court win. And for now we are back to betting on court outcomes.

By this I assume you mean monetizing the pittance they get now. In which case I have to ask ???!!! That option is still open regardless of what happens in the court case - so giving all rights away for a monetization of a pittance is a very odd thing to do especially when they have no particularly urgent need for cash.?
