First off, nothing says Amphastar has too 'make good' anything and secondly, just because Amphastar couldn't make good that doesn't demand that Watson has to pick up the backside.

Could we not argue by assertion? If you want to claim "deep pockets" doesn't exist as a legal precedent and that indemnification always works then please provide data. I think you will find that deep pockets breaking of indemnification does work - the only question is how much.

This morning Watson said they have $6 Billion they intend to spend soon on branded products.

They don't have $6B. Nowhere close. Not even close to $1B in liquid assets. Read their financials.
