I agree.

Clearly MNTA would have been better off to have settled yesterday, but it would have been difficult to do. It should be easier now, but the terms will be very difficult to agree to. Plus, I think that MNTA will want to have the court confirm its IP, so I am not optimistic that it will happen. Financially that will be a problem for MNTA since it will have a huge part of the damage, but will have to agree with NVS as to the split of any damages since the court should not consider the terms of the joint venture when determining damages.

I still find it hard to believe Watson will launch if the reason for the stay on the PI is the lack of irreparable harm.

Why would MNTA settle if Watson/Ampha launches? That would irrevocably change the economics of their deal and they might be better off seeing the litigation through.
