Semantics seem to be a problem around here.
You're right. This case technically can't settle out of court. A complaint has been filed and the judicial process has begun. However, the case can be settled prior to trial......presentation of evidence to a jury......which, in lay terms, has been considered to be "out of court". I believe, however, that any settlement achieved after the case has been filed, but pre-trial, must get the court's approval.
