What you state sounds like the FDIC is supporting JPM's Claim to the Anchor Litigation proceeds whereas I was under the impression that the FDIC is fighting with JPM for control of the Anchor Litigation proceeds.

Is there a reason that this could not have been a 363 sale? Does the FDIC have the authority to do a 363 sale?
