Um, it might be an impediment if the EC backs out assuming that $1.9 billion in assets (attributable to the $5.4 billion in now restricted and otherwise unrestricted NOL's), goes out the window.

So you are most likely correct on this issue. I just tossed that out there for those that might care about those crazy little footnotes in a DS. Who reads them, any way? Hell, who reads the ENTIRE DS?!
