The contention is that Saddam is the one who is harboring and trying to get the WMD and who is in violation of terms as of end of Gulf War as he agreed to. The use of the words "Saddam is in violation" really means Iraq is in violation. No, the decisions of the U.N. in this respect do not apply to the President, but they could apply to the U.S.

It depends on how the resolution is worded. Security Council Resolution 687 is the one which forbids Iraq from having certain weapons, and those provisions apply only to Iraq.
