In the case of Clean Power, which is based in Regina, the SEC alleged that Eiten falsely claimed in May 2010 that the company's "proprietary technology [is] held airtight by the company," when it had only one patent pending and did not own any intellectual property.
Eiten also claimed Clean Power was "strategic partnering" with two large and well-known corporations, Cargill Inc. and Bunge Ltd., but the SEC alleges it was only an occasional purchaser of their products.
(Although not mentioned in the SEC complaint, the disclaimer reveals that a third party named Blixen Services Inc, paid $16,500 for the report and another $650,000 to distribute it.)
