I doubt the appeals court would take any action on the case before it received the DC record.

While improbable, it is possible that A&W could ask the Fed. Cir. to immediately stay the lower court's injunction order on grounds amounting to an egregious abuse of discretion on the part of the lower court. Not likely to succeed,IMO.
