Rick Shea said at the BioCentury webcast on 10/21/11 that MNTA had withdrawn the claims on the ‘886, so he must have mistakenly reversed the patent numbers.

Or perhaps it's simply a transcript error.

Shea must have misspoke, since the term "determining" the judge requested a Rule of Law on is prevalent throughout nearly all of the sixty 886 claims.
