Momenta said it cannot determine whether or not the '466 patent was infringed, but it definitely thought the '886 patent was, and that is the only one they argued to the judge on Friday.
I think you need to swap places for '466 and '886 in your post.
I haven’t yet read the Court transcript for the hearing on 10/20/11, although I intend to read it. Rick Shea said at the BioCentury webcast on 10/21/11 that MNTA had withdrawn the claims on the ‘886, so he must have mistakenly reversed the patent numbers.
