MNTA would still benefit significantly if it obtained a PI against Amphastar:

a) The current hybrid arrangement, while not as lucrative, is still better than a flat royalty arrangement.

b) It would validate its patent position and make it unlikely TEVA could launch if they ever got approval.

So the Judge's decision is still important, although we can put aside talk of new highs etc. at this point if MNTA receives a PI.
