Amphastar’s argument with respect to bidding on GPO contacts does not hold water, IMO. Thus, the pending decision of consequence in this case is whether the Judge will grant MNTA’s Motion for limited expedited discovery. If the Judge does allow limited expedited discovery, I think it’s close to 100% that he will also keep the TRO in effect (or issue a new TRO to supersede the old one).

When I read the comment, it wasn't clear to me if Amphastar sold Enoxaparin or some expiring baby asprin under this claim?

To the contrary, Mr. Liawatidewi tells us that Amphastar has successfully sold “short dated product in the recent past.”
