Its a consumer responsibility to consume beverages resposibly!

In a perfect world, yes, it is. But when they fail to, lawyers will find a way to pin it on someone else. Happens every day.

Again, I never said "this will happen", I said it's worth considering. If you considered it and don't find it valid, that's fine. But if you think the way liability claims get thrown around in this country today stops with responsible consumer behavior, you aren't paying attention.

Are you familiar with this case?

http://en.wikipedia.org/wiki/Liebeck_v._McDonald%27s_Restaurants

Some stupid woman spilled coffee in her lap after she drove away from the driveup and McDonalds ended up paying her $640,000 because she claimed the coffee was "too hot". To this day, McDonalds serves its coffee at a reduced temperature and has to label the cups as a result of this silly lawsuit and you can bet the underwriters of their liability insurance insist on these conditions.

Currently the only condition necessary to sell drinks like Koma Unwind is proper labeling on the can identifying it as a Dietary Supplement, which was brought about by the FDA rattling the cage of the makers of Drank. If this niche becomes more prevalent, more attention will come upon it and you can expect greater regulation if for no other reason than as a political football.
