Do you understand the concept of 'intended use' as it applies to liabillity? Nyquil isn't sold to be guzzled in the 'stoor', whereas a chilled beverage purchased from a cooler in a convenience store is clearly intended to be consumed immediately.
The liability is something worthy of consideration. If you don't want to worry about any of this because you just want to buy shares in a pump and dump penny stock and make a quick buck, that's fine. But making specious arguments isn't going to boost your gains.
