The markets closed out the trading session mixed today as a big drop in crude oil inventories, while lower than expected, added to a lingering concern that high energy prices will speed inflation and slow economic growth. The big news of the day was Ameritrade's (Nasdaq: AMTD RT$) merger with rival TD Waterhouse in the online brokerage sector.
Volume was light with 1.79 billion shares trading on the NYSE and 1.67 billion on the Nasdaq. Advancers outpaced Decliners today by a margin of 19:14 on the NYSE and by a margin of 16:14 on the Nasdaq.
In individual stories, Datawatch Corporation (Nasdaq: DWCH RT$) closed 23.08% higher as momentum players drove the stock up after the company announced the general availability of Visual/Productivity Portal for IBM WebSphere. On the downside, Arbinet-thexchange, Inc. (Nasdaq: ARBX RT$) closed 34.78% lower after warning for Q2 and FY05.
Tomorrow, traders will be watching for data on Initial Claims and Existing Home Sales. Initial Claims are due to hit the wires at 8:30 A.M, and Existing Home Sales are expected at 10:00 A.M.

-Update- Co reports that a communication from the U.S. Patent and Trademark Office (USPTO) reported today does not concern the validity of the basic ('893) and enantiomer ('995) patents providing market exclusivity for Lipitor through March 2010 and June 2011, respectively. Those patents remain in force and, therefore, there are no approved generic forms of Lipitor. The USPTO communication is not a final decision but instead a preliminary finding regarding one of several other patents covering Lipitor (atorvastatin calcium). The only patent at issue in the USPTO proceeding is the '156 patent, which concerns the crystalline form of Lipitor and which expires in 2017.

The agreement calls for 10.7 acres of real estate and improvements to be divided into two parcels with the first parcel closing on or before July 15, 2005, and the second parcel closing on or before April 1, 2006. Trademark has the option to extend each closing up to three times for thirty days each with the payment of a non-refundable extension fee. Kirk and Blum will have the right to occupy both premises with no rent obligations for a period of up to ten months following the closing on the first parcel and a search is underway to find a suitable replacement property that will qualify the transactions for treatment as a tax free real estate exchange. The total value of the contract is $8 million consisting of $6.9 million for the first parcel and $1.1 million for the second.
