Yup. That's why when people boil down that slide and hearing into a singular number and start tossing it out -- forgetting what it means, and what it doesn't mean, then they've lost sight of certain key elements.
Remember: To get to that number, one must litigate everything, and win everything, including appeals, etc. If one expects to settle, AND have everything be at the high end of the scale, then they don't understand the compromise nature of what a settlement means.
That's why context matters. And why I referred people back to the transcript, and the audio of the hearing, and to read the whole set of slides, etc, etc.
