I read this on a message board; The modern definition of prohibiting something is to leave it technically legal but burying it in so many regulations, fees and licenses to make it virtually impossible for a person of average means, knowledge and connections to conduct it with any level of profit margin or benefits.

Is it just retail that is effected? Or does it include institutional?

Keeping just retail investors out of the loop would be dangerous.
