It's fair to assume the Mediation is ongoing, but I wouldn't put too much faith in it.
I do NOT believe the Rodent & Company will be mediating in good faith with Arthur Steinberg.
Go back and listen to the audio at the last court hearing (in April 2011), where Rosie was hell-bent on NOT participating in Mediation with DIMEQ holders; ironically, Rosie was just as hell-bent on forcing other parties into Mediation with him. It's safe to assume that there is a lot of bad blood between Rodent and Steinberg. Then again, Rodent is clearly outclassed by Steinberg.
Think of Steinberg as a gentleman and a top-notch lawyer, and Rodent as an unscrupulous, unethical, dishonest shyster, a thug, a bully, and a total shill for JPM (JMHO, of course, based on his continuing course of conduct in this case). I could be very wrong about Rosie; he may be the complete opposite of the a$$ he portrays himself to be in court, but I'm just going based on the way he carries himself in court.
Steinberg is cool, calm and collected; Rosie, not so much.
Compare and contrast, and you will notice that Steinberg and Rodent are not cut from the same cloth.
My money is on Steinberg.
Again, based just on what I've seen/heard/read.
Now, WRT hard working and excessive (read: padded) billing, there are few out there as "hard-working" as Rodent. Nobody even comes close. Check out his billings to the court for the month of November 2010 and you will notice that this guy doesn't appear to have much of a life.
He seems to work round the clock, nights, weekends, holidays. He's the guy I would go to if I were trying to find 28 hours in a 24 hour day.
Compare WGM's billings vs. the Equity Committee's billings. Just because you CAN milk the Estate doesn't mean you HAVE TO try to rip off some of his constituencies in this matter. Again, some lawyers have class . . . and some don't.
I can only hope that the DOJ looks closer at the requests for payment that WGM submitted for November 2010, and that this guy is investigated for Bankruptcy Fraud (if, in fact, he may have "fudged" a little on his billing numbers to the court). If the appearance is inaccurate, I applaud him for his ability to work so many hours in a month that had only 21 working days (20, if you take out both Thanksgiving Day and the Friday thereafter) - maybe he just enjoys working nights, weekends, holidays. Muy guess is that he'll probably be working (or at least BILLING (and MILKING) THE ESTATE) on Mother's Day this Sunday.
Run the numbers for Rodent's hours for November 2010. It would be kind of funny if it didn't appear that we were getting HOSED and MILKED by this a$$-clown.
