If reclassified as Class 12, then I think that we get the option of selecting stock in the re-organized company as payment.
Personally, I will choose that payment, if available. For one, I can take long-term capital gains as I choose and, secondly, I think that the re-organized company will have some significant value post-BK to potential acquirers.
