1.) So if it not an Hybird plant then why: In addition to Giant King Grass, the license/agreement covers elephant grass and Purple King Grass Does the CT order allow them to not divulge you need both grasses to make seedlings.

A: The seedlings may be a hybrid of elephant and purple king and it may not, we dont know. However the way these are propagated, they are essentially clippings or starts from a plant. I have a house plant(for example) that is originally over 40 years old, older than me yet everyone in my family has a start from this plant and they have grown into HUGE plants just by placing those seedlings in water and they start to root. Giant King Grass is propagated the same way. Sterile plants do not produce buds with reproductive organs and perhaps the GKG is exactly that, sterile and that is why they need to clip seedlings from the plants.

2.)If China gate has no interest in Growing or Mmarketing this Hybrid then where did the seedlings for this come from abd why this statement: IPA China purchased 1.2 million seedlings under the agreement, which also provided that China Gate agreed to refer any of its future sales over small quantities (20,000 seedlings

A:Prove it, I sure cant find anything. Where are they actively selling it, and is it on a global scale or is it at a local nursery that sells to local farmers. Find it


3.) wouldn't say 19,999 seedlings be the perfect size for say a pig farmer to buy directly from from China Gate to plant a crop needed to feed his pigs that would have to be reported to VGE under the agreement. Could this explain why we have not seen any animal feed sales for VGE as promised?

A:Could be the perfect size, but I cant see it anywhere on EARTH that they are trying to sell the grass. I could care less about the stupid animal feed, Lets feed some power plants. If you get too many things going at once you end up with a bunch of unfinished projects. They are trending toward a focus now, and since they have figured out the best market of interest for this product. BIOMASS and ENERGY.

4.)Remember Carl PR'd animal feed sales in 2008 for 2009 and never talked about logs, when he first PR'd the building he said it was for animal feed pellets not logs ... whoops and you all thought he was just a sly fox... How do make pellets and then sell to pig farmers who have their own 19,999 seedlings of a similar grass growing in the back yard...LOL ... nothing stopping China Gate from doing except their lack of interest as you say and as long as they don't GKG grass feed....LOL... oh but wait we saw a website showing GKG grass animal feed pellets didn't we, so someone was making pellets weren't they. The website said contact IPA, yet Carl has never said IPA makes pellets.. strange uh????

A: Whats wrong with exploring your options? BIOMASS is the focus now and the money maker, WHO CARES about animal feed or logs. Sounds more like those were backup plans. Ya they invested some money in that building but if you look at it the log factory doesnt take up much space does it? Logs were a backup and I believe at one point they thought the biomass wasn't gonna work out and dove into the logs. Things Chang(e) - thats for you HEDGE.

The reason we aren't seeing LOGS orders from BIG BOX stores...........

INTELLECTUAL PROPERTY, imho.

I didn't even think about that.

The CERTS was a NO brainer, but intellectual property rights can't/wouldn't be covered by insurance.

Let's say Walmart sold the Green Logs to the guys at the BEACH PARTY. You do know who they are, right?

Let's say it rained and the BEACH PARTY became a CONDO at the BEACH PARTY. The drop in temp was reason to burn some GREEN LOGS in the condo fireplace.

Carl said the logs burned HOTTER and LONGER, right?

The logs burned so HOT that the CONDO caught on fire, and $15,000,000 in damages occurred. If the logs were CERTIFIED, but Walmart was sued for selling the logs, then insurance may cover it.

But let's say the Green Logs did burn HOTTER and LONGER like Carl said, and Walmart couldn't sell them fast enough. Any lawyer for Walmart is going to want to know VGE has FULL RIGHTS to sell this HOT NEW PRODUCT, right?

ESPECIALLY COMING FROM CHINA, the worst place on earth for piracy.

Unless Carl can PROVE they have FULL rights to the intellectual property, I doubt the logs will go anywhere.

Now we see ONE POSTER asking us to prove China Gate is marketing and selling the grass. I actually haven't said they are, only that they could PER VIASPACE.

Yet VIASPACE/IPA can't even say FOR CERTAIN that they aren't INFRINGING on the intellectual property rights of others.

We could be subject to intellectual property rights claims regarding the seedlings.

We are subject to the risk that the seedlings we license infringe or will infringe upon patents, copyrights, trademarks or other intellectual property rights held by third parties. We acquired rights to grow GKG from a seller which we believe held such rights. If any such claim arises in the future, litigation or other dispute resolution proceedings may be necessary to retain our ability to offer our current and future products, which could result in substantial costs and diversion of our management resources and attention even if we prevail in contesting such claims. If we are found to have violated the intellectual property rights of others, we may be enjoined from using such intellectual property rights, incur additional costs to license or develop alternative products and be forced to pay fines and damages, any of which could materially and adversely affect our business and results of operations, or terminate our grass business entirely.
