I’m certain that a separate ruling on the Markman hearing prior to trial is not a legal requirement. A Markman ruling helps the parties tailor their arguments and thereby allows the Court’s time to be used more efficiently during the trial. However, the Judge’s calendar may not allow sufficient time to rule on the claims constructions prior to the start of the trial on 9/7/11.
