Apr 13, 2005 (streetinsider.com via COMTEX) --The Dow finished 104.04 points lower to close at 10,403, the Nasdaq fell 31.03 points to close at 1,974 and the S&P 500 lost 13.97 points to close at 1,173.

The markets closed out the trading session in the red today despite another decline in oil prices as disappointing March retail sales stoked fears of weaker consumer spending and an overall economic slowdown due to higher gas prices. Volume was steady with 2.04 billion shares trading on the NYSE and 1.70 billion on the Nasdaq. Decliners outpaced advancers today by a margin of 23:10 on the NYSE and by a margin of 22:9 on the Nasdaq.

In individual stories, Broadwing (Nasdaq: BWNG) closed 23.14% higher after electing to pay off some debt with cash. On the downside, Magma Design (Nasdaq: LAVA) closed 40.76% lower after suffering a legal setback in its court battle with rival Synopsys Inc. (Nasdaq: SNPS) over patents when the Company's chief scientist and co-founder said that inventions he conceived while working for Synopsys were the basis for some of Magma's products and patents.

Tomorrow traders will be watching for data from Initial Claims and Business Inventories. Both are due to hit the wires at 8:30 A.M.

This division is responsible for reviewing Acusphere's clinical trial results and plans as well as a potential New Drug Application (NDA) for AI-700. The purpose of this meeting was to discuss the rationale behind the Phase 3 clinical design and statistical analysis plan with new members of the division, particularly the new division head, who were not involved in these discussions before the start of Phase 3 pivotal trials, and to receive their feedback. FDA has been proactive and constructive in meeting with Acusphere to provide continuing guidance on its expectations regarding the statistical analysis plan for the Phase 3 trials. Based on this feedback, Acusphere has revised its statistical analysis plan. These revisions require Phase 3 pivotal trial enrollment of approximately 700 patients rather than 600 as had been previously estimated.

Yesterday, Judge Sterns of the United States District Court issued the Memorandum and Order on Claims Construction, commonly known as the Markman ruling, in which the court rejected Diomed's interpretation of certain claim limitations. Instead, the Court agreed with AngioDynamics' position on certain claim limitations and, as a result, effectively reinforced AngioDynamics' position that it does not infringe the '777 patent.
