Yes, I think the new patent is helpful on the non-infringement argument, although it makes no difference on the three other arguments to be proffered in the case—see exwannabe’s post in #msg-59693896.

This [CW’s remark on the CC] could just be posturing and trying not to give away any strategy.

Exactly right, IMO.
