true enough.

bringing a defamation action with the idea that you MAY recover punitive / exemplary damages is generally a very bad idea.

personally, I would NEVER recommend that a client of mine pursue such a cause of action.

the victory here lies in CCME's continued profitable operation of its business, which will result in greater and greater credibility with the Street -- not in pursuing a lawsuit.

Tom, regarding the lingering question of defamation, we can also look to other cases where a website that defames can owe serious cash. See for example this verdict. http://www.citmedialaw.org/blog/2009/125-million-jury-verdict-texas-internet-defamation-case

I have not tracked further to see where in the inevitable appeal process the case is.
