THAT is her best option right there. Letting the EC kill off plan by proving insider trading on the part of the Note Holders will allow her ruling to become "moot". And thereby, unappealable. You are absolutely correct. And well said, btw.
Most judges don't necessarily fear having their rulings appealed, but this one would be an embarrassment. There are so many things wrong with it and it is so poorly written...this one could come back to bite her in the butt.
