CONSENT MOTION FOR EXTENSION OF TIME TO FILE BRIEFS RELATED TO DEFENDANTS’ MOTION TO DISMISS AND MOTION TO STRIKE
Pursuant to Federal Rule of Civil Procedure 6(b), Plaintiff Amphastar Pharmaceuticals, Inc. (“Amphastar”), by and through undersigned counsel, respectfully moves this Court for an Order extending the time to file briefs related to Defendants’ February 2, 2011 Motion to Dismiss and Motion to Strike.
Undersigned counsel has conferred with Defendants’ counsel and is authorized to state that Defendants consent to the submission and granting of this Motion.
The parties request that the deadline to file an opposition to Defendants’ Motion to Dismiss and Motion to Strike be extended to March 3, 2011. The parties also request that Defendants’ deadline to file a reply to Amphastar’s opposition be extended to March 22, 2011.
A proposed Order is being submitted with this Motion

I think we still get to see the redacted FDA memo arguing for dismissal before March 3.
