TEVA suggesting that they could launch in a few months will (IMO) be judged imminent and justify expedited discovery.

I disagree and think the Judge is now likely to rule that NVS/MNTA’s patent-infringement case is premature. I would be happy to be wrong, of course.

Discovery can take years in a complex case

thanks zip. i understand how discovery can drag on when it involves deposing witnesses, getting documents from financial institutions, etc. (my brother is a litigator and has done alot of securities work so i am somewhat familiar with the process). what i don't know is discovery in a patent case specifically, especially when most of the information is readily available - in the form of the ANDA applicatiion and related correspondence with the FDA
