you're missing my point - had they referred to the deficiencies as minor that could have legal implications - i.e. approval is in fact imminent (how could it not be if the deficiencies are only "minor"), and enhance mnta's position for expedited discovery. i agree they included the reference to a minor deficiency letter to insinuate the deficiencies are minor
