i think the likelihood of teva approval is higher

personally i am not selling my shares for the following reasons:

1. the possibility of teva not gaining approval still exists (however small)
2. the turnaround time at the FDA these days is very slow and as dew says they are not bound by the 60 days post-response
3. i think there is a higher chance of a buyout by NVS now that lovenox valuation is clearer
4. there is a chance - however small - that mnta prevails in their lawsuit

and i don't think any of these factors are currently baked into the share price

You are correct.

A major deficiency letter or denial would have spelled the end of T-Enox for the time being at a minimum. This FDA action just keeps the ball rolling.
