The DEC have a "final draft" air permit for JBI. They are holding onto it while JBI complete the application for the newer air permit that will allow them to run more than one machine. Perhaps you can confirm this with the DEC. In the meantime JBI have been given permission to operate while they complete the newer air permit application and the solid waste permit application process. First time the DEC have ever allowed a new company of any kind to do this, they seem to have a lot of confidence in JBI.
