POD Solar CEO Michael Matvieshen did not return calls for comment on Monday or Tuesday.

He told The Examiner in September that his company began having problems with PUI from the time it started construction on the 140-acre solar farm located just northwest of the city.

Matvieshen said the utility used his company to learn how to build a solar farm before terminating the contract without good reason and taking control of the project.

EPOD Solar Inc. built about 2 1/2 MW of the 10 MW facility before PUI terminated the contract, Matvieshen said at the time. He said PUI owes EPOD $6 million for work already completed.

EPOD was the one who will be suing!
