Let's assume, just for the sake of clarity, that TEVA is able to manufacture a copy of drug XYZ without using MNTA's patented methods.

Would you consider as true Bio's assertion that TEVA would be in the clear to manufacture in this circumstance: they used MNTA's patent during discovery, but not manufacture?
