Without re-opening the "crafty Teva" discussion, I must agree with RockRat & akaSidney that Teva does not do anything lightly.

I'm going to extend that view to Momenta and Novartis as far as your "shot in the dark" lawsuit comment of earlier today. I just can't believe that either company wastes their ammunition.
