I have to agree, the Hoffman letter was a targeted, focused, and legally sound admission. And it got the attention of Weil, etc.

Either way, I have to agree with Nurse Jeff here, unless Susman pulls out a game changer next week or during the valuation hearings we're in deep doo doo. There is no point in wearing the rose-colored glass here; we are in trouble, and need to see that 800 pound gorilla shake some bananas off the tree for us.

Actually, an ex parte communication is simply a communication with the court that is not also shared with the other parties. Some ex parte communications with the court are allowable, but in most instances, all parties must be served so that they're aware of the pleading or whatever it is.

So any communication, whether a letter or a motion or whatever, is not ex parte and is acceptable if it otherwise conforms to the rules if all parties are served.
