re the BU$$, there was news this morning that the Judge in the VA trial against Infineon refused to allow discovery on some joint defense documents that have come to light in the CA trial vs Hynix. Not sure what is contained in the documents but they were not included in the Infineon privilidged documents log so they might have been fair game. The Judge ruled that Rambus waited too long since discovering their existence, Rambus counters that they only recently learned that they may have included Infineon. More grist for the appeal.

I don't understand the shorting either, but maybe because of the upcoming trial in VA with a Judge that rarely rules in Rambus's favor.

The bu$$ (Rambus, RMBS) was screwed again by by the less than honorable Judge Payne in the Virginia trial part 2. He dismissed the case against Infineon. This is after Rambus was treated pretty poorly in the first trial which was completely overruled later in 2003 by the appeals court. It was sent back to Judge Payne for retrial almost 4 years after the original trial only to be dismissed before Rambus even got a jury or a real trial. As one who has followed this case from the early 1999 period, I am appalled that judges can act this way and stay on the bench. Other judges have ruled on many issues in favor of Rambus. For some reason this judge doesn't even want to give Rambus their day in court. Most likely they will win on appeal as before, but justice delayed is justice poorly served.
Yes I am long Rambus, and even after the drop in after hours trading I'm actually quite in the green still.

Sorry I was away earlier today. This was not really much of surprise and some would argue that it's better to have certainty than the Chinese water torture that we were getting with this misguided judge... The judge in the Hynix case is much, much better. If the stock drops to 11 or so, I'm loading up big time... Of course, the FTC "shoe" could drop any day....
