William... still not sure why the asset list is not required to be included in the DS. Guess I need to go back and do some DD and find out the specific elements that MUST be included in the DS.

I agree with your basic warning and if it gets people to eliminated their stop loss positions prior to the Oct 22 meeting then it would have been worth the attention. But I personally cant buy the judge approving the DS before the examiner's report is filed. She would not have approved the EC and the Examiner if the DS had any credibilty with her. So many thanks for the elegant construct of your case and the warning, it may be the best advise we ever had from this Board.
