From an outside perspective, one could stipulate that a former employee who is suing for damages (likely stock options?) would have one of 2 reasons for doing so:
1. last attempt to squeeze a little money out of a failing company or 2. he/she knows the company will be a huge success, and is bitter that they will not be able to reap the personal profit they'd hoped for
