DEAD wrong. I have read many other post across many websites and no where other than here in your post have i came across information that states the information has to be given over the phone for it to be an ungagged TA...
Read the quote again. It does not say that the information has to be given by phone and only phone for the TA to qualify as ungagged.
If you can get share structure from the TA via "Pony Express " then that means you have access to the share structure and therefor you know what the company is doing with said share structure.
If the TA was gagged as you like to continue to claim, then no one would be able to get share structure information via phone, fax, email, carrier pigeon or pony express. Period.
gagged means you do not have access at all to the information fromt he TA and will not get the inforamtion no matter what you do.
