Pursuant to 11 U.S.C. § 1104(d), in the course of making her appointment subsequent to Mr. Hays’ resignation, the United States Trustee consulted with various representatives of shareholders as well as various creditors and/or their counsel, as set forth below. Given the fact that to date no schedules, statement of financial affairs, or lists of creditors have been filed on the docket, the United States Trustee contacted representatives of shareholders and the creditors who contacted the Office of the United States Trustee or made an appearance on the docket or at hearings held before the Court or contacting the Office of the United States Trustee. The parties who the United States Trustee consulted with are the following:
(a) David Graubard of Kera & Grabuard, counsel to the Debtor; (b) Martin S. Siegel of Brown Rudnick LLP, a creditor of the Debtor; (c) Ira L. Herman of Thompson & Knight LLP, counsel for Madison Square Garden, a creditor of the Debtor; (d) W. Darrell Whitley of Nachamie & Whitley, counsel to many shareholders of the Debtor; (e) Ezzie Goldish, the Chief Financial Officer of Vanity Events, Inc., a creditor of the Debtor; (f) Abbey Walsh of Kleinberg Kaplan Wolff & Cohen, P.C., counsel to Pike Capital Partners, LP and Pike Capital Partners (QP), LP, shareholders of the Debtor; (g) Jonathan Luik of Herrick, Feinstein LLP, counsel to Queens Ballpark Company, LLC, a creditor of the Debtor; and (h) Neal Jacobson, Senior Trial Counsel, Bankruptcy and Enforcement Securities and Exchange Commission.
7. Pursuant to the Trustee Order and as a result of Mr. Hays’ resignation, and after consultation with the parties-in-interest listed above as well as based on the information elicited from interested parties by the United States Trustee prior to the appointment of Mr. Hays, the United States Trustee has selected Kenneth P. Silverman, Esq. as the successor Chapter 11 trustee in this case to replace Mr. Hays.
