Such suits against the FDA have been filed, but they never get anywhere, of course. One I can think of off the top of my head is the suit by Astellas re generic Prograf.
Hypothetically if the court did rule in Sanofi's favor would that not set a precedent for other brands to file similar suits when generics are approved?
