Where did you read that they "shut the stock down to do a share count"? Why would they need to stop trading to count shares. Obviously the TA has the correct count.

He was just appointed and probably needs a week or two to dig into it.

I'm sure if there was a share count discrepancy it would have been noted in the court case document somewhere.

I would feel it would be safe to assume it's 3B or more

schlagrock, what are you talking about? the official notice by the DTCC for the suspension of SPNG mentions nothing about a share count...

http://www.dtcc.com/downloads/legal/imp_notices/2010/dtc/ope/6856-10.pdf

the official notice does however state that the lock was due the SECs case against SPNG which does mention important share count information...

http://www.sec.gov/litigation/complaints/2010/comp21515.pdf

"RM Enterprises is one of the conduits through which Metter, Moskowitz, and Spongetech illegally distributed approximately 2.5 billion Spongetech shares at inflated prices."

"After inflating the price for Spongetech securities through materially false and fraudulent press releases and public filings, Metter,Moskowitz, Spongetech, and RM Enterprises furthered their scheme by dumping approximately 2.5 billion of Spongetech shares on the market in unregistered transactions."

"In private placement transactions executed between on or about March 15 2007, and at least September 2009, Spongetech issued approximately 2.5 billion restricted shares to its affiliate, RM Enterprises, and other affiliated entities, when there was no registration statement in effect. Spongetech, at the direction of Metter and Moskowitz, in effect, used RM Enterprises and other affiliates as conduits throughwhich Spongetech dumped its shares."

Still looking for some good answers

The TA has the exact, up to the minute count at anytime. Why would it be ncessary to shut the stock down? And, no, it is not Mr. Hay's responsibility to ungag the TA as his first act. In fact, it is entirely unnecessary as we already know the OS is at 3 BILLION. (2,999,984,050 to be exact) The court, the TA, SEC, FBI and DOJ all agree on that number. I think that seems pretty reliable ... but thats just me.

Why didn't Hayes ungag the TA. If he was looking our for shareholders as that is his responsibility. That should of been the first thing don't you think.

come on dude, the guy just started .. and the share court has been done by the TA and is listed in the court doc's .. feel free to call the TA .. why rehash something already performed at the request of the SCE and the courts .. fist point of business for the Trustee is too find out just how much the 2 crooks stole and
send the 2 crooks to jail
