Maybe this is the reason why LTW holders should seek legal counsel to represent the entire class. Because your argument will need to be asserted in court by a competent attorney. If it is never asserted in court, the judge is not likely to go out of her way to make such an argument.
I know you or someone else made that argument in a response to WMI's 43rd and 44th Omnibus Objection. But I think a formal legal motion asserting this argument (with all the supporting legal references) would be much more persuasive to the court. This is just my own opinion.
