Calypso really didn't have a choice. The Fed Court agreement only kept the Daic parties from selling the 923 patent, not the other Calypso IP. The state court halted the Daic parties from selling the other Calypso IP. They agreed in the Fed Court to settle their differences and determine who owns the Calypso patents in state court. Calypso needs to rid the Daic parties from any association with Calypso. If Calypso were to win the Tmob case, the issue of who owns the patent and then who gets the money would be decided in state court anyway. There really is no way around going to state court and I think it's better now than later.
