Rallis files declaration in response (6/01/10).

Dean G. Rallis, Jr. had primary responsibility at SulmeyerKupetz for representing the OUCC.

It states that a third party was interested in supporting a OUCC plan and that he requested authority to engage in further discussions. By majority vote, he was instructed not to engage in any negotiations with any secured lenders concerning a Committee plan.

Rallis became concerned that confidential information that SK communicated to the OUCC was being shared with Debtors' representatives.

Minority Members of OUCC file opposition (6/01/10).

EDI Architecture, Inc and GeoDesign, Inc file opposition to retaining Nordman Carmany Hair & Crompton LLP as replacement counsel for SK.

Three members of the Committee, Kirman Plumbing, Complete Thermal Services and L.P. Carreras (referred to the "Friendly Committee Members") continue to do work the Debtors in their respective areas of expertise which are plumbing, HVAC and accounting. GeoDesign, a fourth member, continues to perform geotechnical engineering work.

EDI and Geo in two separate complaints have communicated a list of seven issues to the United States Trustee.

The filing also details that Mr. Winfield, counsel at Nordman, and Mr. Maddux have known each other for 35 years. They played sports together in high school, attended the same college and represented the company founded by Mr. Maddux's father-in-law.

The brother of David Gill, senior partner at Danning Gill Diamond & Kollitz (Debtor's counsel) is "of counsel" at Nordman.

The UST has received solicitation letters from two new potential Committee members.
