Yes, the judge will make the decisions. I must admit I was surprised by his decision to not get an examiner, going against the trustee's suggestion. In practice I doubt the judge reads everything relating to a case this large because I'm sure he has several cases on his docket. I doubt he would have the time to read every motion, financial analysis, etc because lets face it lawyers aren't short on words. He probably has people that read it for him and give him their cliff note version. I thought he would look to the trustee for a lot of the analysis but perhaps he had others who advised against or he thought it might be quicker without the examiner and felt it could be revisited later should the 4 legal teams not reach a reasonable compromise(good luck!). I doubt very much he is foolish enough to take any one of the legal teams side as the 100%, undeniable truth.
