As to the first question, basically the decisions issued by the judge thus far reflect that he understands that Hynix' only defense against infringement as to a few of the claims is dependent upon the Court adopting the claim construction Hynix advanced. Since, as to those few claims, the Court in fact rejected Hynix' claims construction, summary judgment seems inevitable as to those claims. This still leaves Hynix with an invalidity argument, but should logically give RMBS infringement for now.

As to the box, this is a close call. Most of my colleagues expect us to jump to the new box. However, there is still a lot of trouble brewing in the IFX case, and even some risk in the FTC case, so it is very hard to determine how long any "good" news will dominate. My best guess is that we might jump to the new box at least briefly if in fact we get the key rulings we suspect today or tomorrow.
