I am not convinced that legal action will do anyting for shareholders. Such action only benefits lawyers. More importantly, there has not been anything unlawful here. Stock promotions happen all the time. If disclosed, there is nothing you can do about it. Naked short selling is a problem not limited to APRO, but every stock potentially. And if a disgruntled former owner decides to bail her shares at any price, there is nothing the firm can do about it.

If, on the other hand, you claim fraudulent activity in the way DFCO was rolled-up, then a class action suit for APRO is the wrong starting point. This company has a different CEO, and to this point I am not convinced that management is acting unlawfully here, just not as transparent as we all wish.
