Amtech comments that there have been a couple of incremental legal developments in the past week which have not been as favorable to the RMBS bull case. The first relates to potentially opening up the book on "crime-fraud" in the Hynix case (related to alleged document destruction by RMBS). The second relates to an IFX motion to dismiss the patent case in Virginia on the issue of "spoilation" (related to the issue of document destruction). It appears to firm that RMBS' stock price movement over the past two months may not be ideally discounting some of the potential legal set-backs that may be looming. This brings firm back to the primary issue that made it cautious on the stock earlier this year (before the downward move from $21.11): when does RMBS realistically start getting paid by Samsung (other than the current minimum) and the holdouts? Firm retains its HOLD rating and $18 price target.
